“Content” – Refers to all materials made available on Nexbien’s platform, including but not limited to study materials, videos, text, images, documents, assignments, software, digital tools, interactive features, and any other resources provided by Nexbien or its Teachers.

“Account” – Refers to the registered user profile required to access Nexbien’s Services. Accounts may be created by Students, Parents/Guardians (for minors), or Teachers, and each account is subject to Nexbien’s eligibility and verification requirements.

“Platform” – Refers to Nexbien’s digital ecosystem, including its website, Learning Management System (LMS), mobile applications, and any other digital tools or systems used to deliver educational services.

“Learning Management System (LMS)” – Refers to Nexbien’s online educational infrastructure that facilitates live classes, recorded sessions, interactive learning, student progress tracking, assignment submissions, and communication between students and teachers.

“Tuition Fees” – Refers to the charges applicable for enrolling in online tuition services, which must be paid by the Student (or their Parent/Guardian) as per Nexbien’s Payment Policy.

“Third-Party Services” – Refers to external entities, such as payment gateways, cloud hosting providers, content delivery networks, and other service providers, that facilitate aspects of Nexbien’s platform. Nexbien does not control or take responsibility for Third-Party Services.

“User-Generated Content” – Refers to any content, including text, images, videos, feedback, ratings, or other materials uploaded, posted, or shared by Users on Nexbien’s platform.

“Unauthorized Access” – Refers to any activity where a User or third party gains access to an Account or Platform resources without proper authorization, including hacking, password sharing, or data breaches.

“Intellectual Property” – Refers to all proprietary rights associated with Nexbien’s platform, including but not limited to logos, trademarks, copyrights, software, course materials, lesson plans, and any other original content owned or licensed by Nexbien.

2. USER REGISTRATION & ELIGIBILITY

Minors (students below 18 years) may access our tuition services only under the supervision of a parent or legal guardian, who must consent to these Terms of Service on their behalf.

Accurate Information: All users, including students and parents, must provide accurate, up-to-date, and complete personal information, such as full name and contact details. Providing false or misleading information may result in account suspension or termination.

Approval of Registration: Nexbien reserves the right to approve, reject, or suspend any user registration at its sole discretion without providing a reason.

2.2 Account Security

User Responsibility: Users are solely responsible for maintaining the confidentiality of their login credentials, including their username and password. Any activity conducted through a user’s account will be considered as their responsibility.

Nexbien will take necessary actions, but it is not liable for any loss arising due to delayed reporting by the user.

Account Suspension & Termination: Nexbien reserves the right to suspend or terminate user accounts under the following circumstances:

3. SERVICES OFFERED
Nexbien Ventures Pvt Ltd provides an online tuition platform catering to students of Class IV to VIII under the CBSE curriculum. The Services include but are not limited to:

Live Online Classes: Interactive sessions conducted by experienced teachers for Mathematics, English, Hindi, and Kannada.

Recorded Lessons: Access to recorded classes and supplemental learning material.

Learning Management System (LMS): A centralized system for students and teachers to manage classes, assignments, and progress tracking.

Homework and Assignments: Students can submit assignments, and teachers provide feedback through the platform.

4. PAYMENT & FEES

4.1 Tuition Fees

4.1.1 Fee Structure:

Tuition fees are determined based on the course, subject, duration, and the teacher’s expertise level.

Nexbien Ventures Pvt Ltd ("Nexbien") reserves the right to revise the tuition fees at its discretion. Any changes will be communicated in advance to enrolled students.

4.1.2 Payment Methods:

All fees must be paid in full before accessing any classes.

Payment must be made through the authorized payment gateways listed on the Nexbien website. These may include credit/debit cards, UPI, net banking, digital wallets, or other payment methods as updated from time to time.

Nexbien does not accept payments made outside the authorized payment channels. Any loss due to unauthorized payments shall not be the responsibility of Nexbien.

4.1.3 Billing and Invoices:

Upon successful payment, students/parents will receive an electronic receipt via email.

If a student requires an invoice for tax or reimbursement purposes, they must request it via the customer support portal.

4.1.4 Non-Payment Consequences:

Failure to complete payment may result in restricted access to the learning platform.

If a student’s payment is delayed beyond a specified period, Nexbien reserves the right to suspend or terminate access to ongoing and future sessions until dues are cleared.
5. USER RESPONSIBILITIES

All users of Nexbien Ventures Pvt Ltd ("Nexbien")—including students and parents—are required to adhere to the following responsibilities while using the platform.

5.1 General Responsibilities of All Users

Users must provide accurate, complete, and up-to-date information during registration and maintain the confidentiality of their account credentials.

Users must not share their login credentials with anyone or allow unauthorized access to their accounts.

Users are responsible for ensuring stable internet connectivity and using a compatible device to access online classes.
-
Users must respect the integrity and security of the platform by not engaging in activities such as hacking, data scraping, or unauthorized access.

Users must not upload, post, or transmit any offensive, harmful, defamatory, obscene, or illegal content on the platform.

Any misuse of Nexbien’s platform, including unauthorized recording, sharing, or reproduction of course materials, is strictly prohibited.

5.2 Responsibilities of Students and Parents

5.2.1 Attendance & Punctuality

Students must attend classes on time and be prepared with the necessary study materials.

Parents should ensure their child’s participation and monitor their academic progress.

5.2.2 Behavior & Conduct

Students must maintain discipline and decorum during live sessions and interactions with teachers and fellow students.

Any disruptive, inappropriate, or disrespectful behavior (e.g., bullying, abusive language, offensive gestures) will lead to disciplinary action, including possible suspension from the platform.

If a student faces any issue with a teacher or other students, they should report it to Nexbien’s support team instead of engaging in disputes.

5.2.3 Usage of Study Materials

Course content, including videos, assignments, and notes, is for personal educational use only.

Students/parents must not share, distribute, or resell Nexbien’s learning materials to third parties.

5.2.4 Device & Technical Responsibility

Students must ensure their devices (computer, tablet, or mobile) meet the technical requirements for online learning.

Nexbien is not responsible for student-side technical issues such as weak internet connection, incompatible devices, or software failures.

5.3 Prohibited Activities

All users are strictly prohibited from engaging in the following activities:

Plagiarism: Copying, reproducing, or redistributing Nexbien’s learning materials without permission.

Cheating or Misrepresentation: Any form of cheating, including unauthorized assistance during assessments.

Disruption of Services: Attempting to disrupt the platform’s operations through hacking, spamming, or cyberattacks.

Harassment & Abuse: Any form of verbal, written, or online harassment towards teachers, students, or support staff.

Unauthorized Business Promotion: Using the platform for advertising, marketing, or soliciting personal business.

Unauthorized Access & Security Violations: Users must not attempt to gain unauthorized access to Nexbien’s systems, data, or accounts belonging to other users. This includes using backdoors, bypassing security measures, or tampering with Nexbien’s code, software, or servers.

Automated Data Extraction: The use of bots, scrapers, or automated scripts to extract, copy, or index content from Nexbien’s platform is strictly prohibited.

Misuse of Communication Tools: Users must not send spam, promotional messages, or unsolicited advertisements through Nexbien’s platform.

Impersonation & False Representation: Users must not impersonate Nexbien staff, teachers, or other members, or falsify their identity for deceptive purposes.

External Payments & Circumvention: Students and parents must not engage in off-platform transactions to circumvent Nexbien’s payment system. All course payments must be processed through the platform.

5.4 Consequences of Violations

Nexbien reserves the right to take disciplinary action against users who violate these responsibilities.

Depending on the severity of the violation, actions may include:

Warning or suspension of user access.

Permanent account termination without refund.
-
Legal action, if necessary, in cases involving intellectual property theft, harassment, or fraudulent activities.

Users violating policies may be permanently blacklisted from re-registering on Nexbien.

By using Nexbien’s platform, users agree to comply with these responsibilities. Failure to do so may result in penalties, suspension, or permanent removal from the platform.
6. INTELLECTUAL PROPERTY RIGHTS

6.1 Ownership of Intellectual Property

All content, materials, and resources available on Nexbien Ventures Pvt Ltd ("Nexbien"), including but not limited to text, videos, graphics, course materials, assignments, assessments, software, website design, logos, and trademarks, are the exclusive property of Nexbien.

Users (including students and parents) are strictly prohibited from:

Recording, downloading, screenshotting, or sharing online classes, videos, or study materials outside of the Nexbien platform.

Using Nexbien’s logos, branding, trademarks, or domain names without explicit authorization.

Creating derivative works based on Nexbien’s courses, training materials, or any proprietary content.

Removing or altering copyright, trademark, or other proprietary notices on Nexbien materials.

Note: Violation of these restrictions may lead to immediate suspension or termination of user access and may result in legal consequences.

6.3 User-Generated Content & Contributions

If a user (including teachers and students) submits, uploads, or shares any comments, feedback, questions, study materials, assignments, videos, or other content on Nexbien’s platform, they grant Nexbien a worldwide, royalty-free, non-exclusive license to use, distribute, and modify such content for educational and promotional purposes.

However, Nexbien will not claim ownership over original user-generated content unless explicitly agreed upon.

Users are responsible for ensuring that any content they upload does not infringe upon third-party intellectual property rights.

6.4 Copyright Infringement & Reporting

7. TERMINATION OF SERVICES

Repeated failure to comply with online behavior.

Non-Payment of Fees:

Students who fail to pay the required tuition fees on time may have their access to courses suspended or permanently revoked until outstanding dues are cleared.

If a student is found engaging in fraudulent payment activities, Nexbien reserves the right to take legal action.

Disruptive or Unethical Conduct by Students:

Students engaging in harassment, bullying, offensive language, or misconduct towards teachers, staff, or fellow students will face immediate suspension.

Any behavior that disrupts the learning environment, misuse of course materials, or involvement in any fraudulent activities may result in permanent termination.

Fraudulent, Abusive, or Unauthorized Activities:

Users involved in cheating, hacking, unauthorized access, misrepresentation, sharing login credentials, or any form of cybersecurity threats will be permanently banned.

Any attempt to circumvent payment methods, exploit referral programs, or engage in activities harming Nexbien’s reputation or financial interests will lead to strict legal action.

7.2 Effect of Termination

Upon termination of a user’s account:

The user will lose access to all courses, study materials, and related services on the platform.

No refunds or reimbursements will be provided for payments already made

Nexbien reserves the right to permanently ban repeat offenders and report violations to appropriate authorities if necessary.

7.3 Appeal Process

Users whose accounts are suspended or terminated may submit an appeal within 7 days from the date of termination by contacting contact@nexbien.com with a detailed explanation.

Nexbien will review appeals on a case-by-case basis and may reinstate access if valid justifications are provided.

However, by using our services, users acknowledge and agree that Nexbien, its directors, employees, affiliates, and service providers shall not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of data, revenue, or business opportunities arising from the use of our services. 9.2 Financial Losses Due to Unauthorized Account Access

Users are solely responsible for maintaining the confidentiality of their login credentials (username, password, OTPs, etc.).

If a third party gains unauthorized access to a user’s account due to negligence, phishing attacks, or data breaches outside of Nexbien’s control, Nexbien will not be liable for any resulting financial losses.

Nexbien reserves the right to freeze suspicious accounts and initiate security checks to prevent fraudulent transactions. However, it is the user’s responsibility to report any unauthorized activity immediately.

9.3 Student Performance Outcomes Resulting from Tuition Services

Nexbien provides structured learning programs and experienced educators, but does not guarantee specific learning outcomes, academic success, or examination performance.

Student progress depends on multiple factors, including individual effort, learning pace, prior knowledge, and personal circumstances.

Nexbien is not responsible for poor academic results, failure in examinations, or non-improvement despite attending tuition classes.

The platform offers educational guidance but does not replace formal school education or professional coaching institutes.

9.4 Acts of Third-Party Service Providers (e.g., Payment Gateways, Hosting Platforms, etc.)

Users acknowledge that Nexbien does not control these third-party platforms and cannot be held liable for:
